The case <a href=\"https:\/\/randazza.com\/wp-content\/uploads\/Soto-Lowry-Order.pdf\">against Briana was dismissed<\/a> after successfully arguing an anti-SLAPP motion.<\/p>\n<p>I have my own experience with anti-SLAPP motions, after having been sued for $270 million by Medifast, a scammy MLM that peddled diet products under the brand Take Shape for Life (now called Optavia). <a href=\"https:\/\/www.sequenceinc.com\/fraudfiles\/2011\/03\/medifast-take-shape-for-life-lawsuit-total-vindication-for-tracy-coenen\/\">I won my anti-SLAPP motion to dismiss<\/a>, and then <a href=\"https:\/\/www.sequenceinc.com\/fraudfiles\/2015\/06\/the-price-of-free-speech-is-200000\/\">Medifast had to pay nearly $200,000 in legal fees to me<\/a>.<\/p>\n<p>Kail sued Briana for defamation in June 2021 after Briana said that Kail&#8217;s ex-boyfriend Chris said Kail physically assaulted them. Briana&#8217;s win was really simple: She told the truth. Chris did, in fact, tell her that Kail assaulted him.\u00a0 And there was no evidence that Briana knew that the statement was false.<!--more--><\/p>\n<p>And now Kail will most likely have to pay <a href=\"https:\/\/www.thehollywoodgossip.com\/2022\/04\/briana-dejesus-i-won-the-suit-kailyn-owes-me-$120k-in-legal-fees\/\">Briana&#8217;s legal fees, which are over $120,000<\/a>. Under Florida law, the winning party is entitled to recover legal fees from the loser after an anti-SLAPP motion. If Kail and her attorney are smart, they&#8217;ll settle on the issue of fees rather than go in front of the judge.<\/p>\n<p><a href=\"https:\/\/www.celebuzz.com\/g\/briana-dejesus-exclusive-lawsuit-4-18-22\/2\/\">Marc Randazza is a rock star<\/a> and Briana was brilliant to hire him to defend her.
