{"id":22551,"date":"2025-10-14T06:00:37","date_gmt":"2025-10-14T11:00:37","guid":{"rendered":"https:\/\/www.sequenceinc.com\/fraudfiles\/?p=22551"},"modified":"2025-12-05T16:27:27","modified_gmt":"2025-12-05T22:27:27","slug":"when-legal-experts-get-the-law-wrong","status":"publish","type":"post","link":"https:\/\/www.sequenceinc.com\/fraudfiles\/when-legal-experts-get-the-law-wrong\/","title":{"rendered":"When Legal Experts Get the Law Wrong"},"content":{"rendered":"<p>Sam Antar was <a href=\"https:\/\/www.sequenceinc.com\/fraudfiles\/who-broke-the-letitia-james-mortgage-fraud-story\/\">the first professional to report on the Letitia James mortgage fraud case<\/a> because he was the person who uncovered it.\u00a0 Although the media tries to report on the case, they keep getting it wrong, and it is so simple for a forensic accountant like Sam to point us back to the documents (i.e. evidence) to get it right.<\/p>\n<p>In a new analysis, Antar dismantles <a href=\"https:\/\/www.lawfaremedia.org\/article\/the-justice-department-s-dangerously-weak-case-against-letitia-james\">Lawfare\u2019s defense of New York Attorney General Letitia James<\/a>, who was recently indicted on federal bank fraud and false statement charges. The article calls the case against James &#8220;weak&#8221; and says that when James misrepresented the Virginia home as &#8220;her primary residence,&#8221; this was not false because it was a primary residence for James&#8217;s niece. The author says that to succeed, the government will have to prove that James knowingly made a false statement with intent to deceive, and that it&#8217;s going to be hard to prove intent.<\/p>\n<p>Lawfare bills itself as a source for analysis of legal issues, and says it&#8217;s &#8220;thorough.&#8221; But it&#8217;s analysis of the mortgage fraud case is so flawed on basic level. Antar points out that instead of addressing the evidence, Lawfare resorted to attacking his credibility, calling him a \u201cconvicted felon\u201d and mocking his expertise as a \u201cfraud expert.\u201d<\/p>\n<p>His response: Yes, I\u2019m a convicted felon. That\u2019s exactly why I know fraud when I see it.<\/p>\n<p>The article focuses on the documents at the heart of the indictment, which show four conflicting sworn statements James allegedly made about the same property:<\/p>\n<ul>\n<li>To the bank: Claimed it was a second home for a lower interest rate.<\/li>\n<li>To the insurance company: Reported it as owner-occupied.<\/li>\n<li>To the IRS: Reported zero personal use days and claimed rental deductions.<\/li>\n<li>To New York State: Labeled it as an investment property.<\/li>\n<\/ul>\n<p>Antar points out that at least three of these statements must be false, and that the Second Home Rider she signed explicitly defines misrepresentations about occupancy as material fraud.<\/p>\n<p>He also takes aim at Lawfare\u2019s interpretation of contract language, calling it \u201c<strong>legal malpractice dressed up as analysis<\/strong>.\u201d Their argument that the mortgage rider\u2019s requirements are \u201csquishy,\u201d he says, ignores plain language like \u201cBorrower will occupy and use the Property as Borrower\u2019s second home.\u201d<\/p>\n<p>Antar concludes that the evidence speaks for itself. Documents don\u2019t lie.
