You know what I’m talking about. The blog article or LinkedIn post that was clearly written by artificial intelligence like ChatGPT or Claude. Someone took a thought and had AI churn out an article with little to no effort, because clearly posting some sort of content is the goal, no matter the quality.

I’m tired of reading this AI slop. I see people on LinkedIn who are holding themselves out as forensic accounting experts, yet it’s clear to me that they have little to no REAL experience investigating complex frauds. They want you to think they know how to investigate, but they don’t because they haven’t really done it. And attorneys and their clients may not realize this because what they’re seeing is content that gives the appearance of expertise.

This whole concept of generating AI slop can get even worse. A little post on social media is one thing, but entire court filings from attorneys…. that is next level. We’ve all heard about attorneys getting in trouble for using AI to write legal briefs that cite nonexistent cases. But an attorney in Florida recently got in trouble for something a little different. She filed legal briefs that had real citations, but the judge thought her arguments were terrible.

A Florida appeals court actually referred her to the Florida bar for possible discipline for her AI slop. The judges said her lengthy filings in a divorce case were unfocused, repetitive, and filled with arguments that didn’t make sense. They suspected that parts were generated by AI without sufficient independent analysis by the attorney.

What interests me is that the court is speculating that the filings were generated by AI, at least in large part. I think I have a pretty good eye for detecting writings done by AI. The court apparently feels confident in its ability to do the same. But how can you know for sure? What if she’s just a bad writer or a bad attorney, and she put together arguments in the divorce case that weren’t great? Maybe she used AI to help her write a little, but the ideas were her own?

This is all going to be so interesting as AI progresses and more professionals integrate it into their work. What limits should we put on ourselves for the use of AI? How do we ensure the quality of our work remains high? What should we be disclosing to clients about our use of AI?

I like the idea of using AI to help with my work. Maybe AI can analyze a large database of transactions and identify unusual payments or patterns that aren’t easily identifiable. This a great use of AI. But even when those things are identified, my client still needs my investigative skills to dig further into those transactions to come to proper conclusions. It would be irresponsible to just take an analysis from AI and use that as my work product. Clients aren’t paying me to type instructions into an AI tool. They’re paying for more than 25 years of experience investigating financial issues, evaluating evidence, and reaching conclusions that I can defend in court.

This is essentially the problem the judges in Florida identified. A document that looks professional isn’t necessarily a competent piece of work. There is a smart and professionally responsible way to use AI in our work, but professionals have to be very careful. AI can make our work more efficient and strategic, and it can assist with some tasks. But I would never generate a report using AI. Clients hire me for my expertise, and part of that expertise is knowing how to put together a report in the best way. I’m not farming that out to Claude!

Are we all sick of “AI slop” yet? You know what I’m talking about.
